FDA Certificate of Product Registration for Drugs and BA/BE in the Philippines

A drug or biologic intended for manufacture, importation, sale, distribution, or other regulated activity in the Philippines generally requires prior authorization from the Philippine Food and Drug Administration (FDA).


For many drugs and biologics, the relevant authorization is a Certificate of Product Registration (CPR). The CPR confirms that the product has undergone the FDA’s regulatory evaluation under the applicable requirements for quality, safety, and efficacy.


The FDA Act of 2009 defines an authorization broadly. It may take the form of a permit, license, certificate of registration, certificate of accreditation, certificate of compliance, certificate of exemption, or a similar document issued by the FDA.


What the FDA reviews?


A CPR application typically requires the applicant to submit documents that allow the FDA to evaluate the product and the conditions under which it will be manufactured and distributed.


Depending on the product and its regulatory pathway, the application may include:


  • the product’s composition and complete formulation;

  • manufacturing, processing, packaging, and quality-control information;

  • details of the manufacturing facility and applicable quality systems;

  • product specifications and certificates of analysis;

  • stability and other quality data;

  • clinical, nonclinical, or other scientific information supporting safety and efficacy;

  • proposed labels, packaging materials, and product information; and

  • other documents, samples, or evidence required by the FDA.


The FDA’s mandate includes the establishment of standards and the testing, examination, and evaluation of health products. It is also authorized to maintain testing laboratories and to use accredited government or private laboratories for the testing, calibration, assay, and examination of health-product samples.


Bioavailability and Bioequivalence (BA/BE) requirements


Certain pharmaceutical products may be required to undergo bioavailability or bioequivalence (BA/BE) testing before a CPR is issued or renewed.


In Republic of the Philippines v. Drugmaker’s Laboratories, Inc., et al. (G.R. No. 190837, March 05, 2014), the Supreme Court explained that the BA/BE requirement was originally introduced by Department of Health Administrative Order No. 67, s. 1989, which governed the registration of pharmaceutical products. The requirement was not immediately enforced because local facilities capable of conducting the necessary studies were not yet available.


The FDA later issued circulars to administer and supervise the implementation of the existing BA/BE requirement. The Supreme Court upheld those circulars because they did not create a new substantive obligation; they merely implemented an existing requirement under Administrative Order No. 67, s. 1989.


The practical implication is important: an applicant should determine at the beginning whether the product falls within a category requiring BA/BE studies or other product-specific evidence. Addressing this issue only after filing may result in additional requirements and delays.


Typical stages of a CPR application


Although the specific procedure depends on the product and application pathway, the registration process generally involves the following stages:


  1. Regulatory assessment.

    The applicant first identifies the product classification, formulation, intended use, route of administration, source, manufacturing arrangement, and applicable FDA requirements.


  2. Establishment compliance.

    The applicant and relevant establishments must have the necessary FDA authorizations and must be capable of complying with applicable manufacturing, storage, distribution, and quality requirements.


  3. Preparation of the application dossier.

    The administrative, technical, quality, safety, efficacy, manufacturing, and labeling documents are compiled and reviewed for completeness and consistency.


  4. Filing and payment of fees.

    The application is submitted through the FDA’s prescribed process, together with the applicable fees and supporting documents.


  5. Technical evaluation.

    The FDA evaluates the application and may issue deficiency notices or requests for clarification. The applicant must respond within the period specified by the FDA.


  6. Testing, inspection, or verification.

    Depending on the product, the FDA may require testing, facility inspection, document verification, or additional scientific support.


  7. Regulatory action and release of the CPR.

    If the application satisfies the applicable requirements, the FDA may approve the application and issue the CPR in accordance with its prescribed release procedure.


Processing and release timelines


The time required to obtain a CPR depends on several factors, including the completeness of the application, the product category, the applicable regulatory pathway, the need for BA/BE or other studies, FDA requests for additional information, and any required testing or inspection.


The materials presently available for this article do not include a current FDA service standard stating the number of days for the evaluation and release of a CPR. For that reason, applicants should not rely on a fixed timeline without first confirming the applicable and current FDA rules, checklist, and filing procedure.


In practice, the registration timeline may be affected by:


  • incomplete or inconsistent submissions;

  • deficiency notices and requests for clarification;

  • the need to submit additional technical or scientific evidence;

  • BA/BE testing or other product studies;

  • inspection or verification of manufacturing facilities;

  • issues concerning labeling or product claims; and

  • changes to the application during the evaluation process.


The safest approach is to assess the product and prepare the dossier before filing. A complete and internally consistent application generally places the applicant in a better position to respond efficiently to FDA comments.


Common preparation issues


Applicants should review the entire submission carefully before filing. Information appearing in the formulation, product specifications, manufacturing documents, labels, certificates of analysis, and supporting studies should be consistent.


Particular attention should be given to:


  1. the identity and classification of the product;

  2. the proposed product name and claims;

  3. the composition and strength of the product;

  4. the manufacturing and testing sites;

  5. the supporting quality and stability information;

  6. the need for BA/BE or other scientific studies; and

  7. the accuracy and completeness of the proposed labeling.


In the case of Cawad, et al. v. Abad, et al. (G.R. No. 207145, July 28, 2015), it was discussed that administrative issuances that merely interpret or implement existing FDA or Department of Health requirements generally do not create new substantive obligations. However, an issuance that introduces a new condition or limitation not found in the governing law or rules may raise separate legal issues concerning publication, filing, and validity.


Post-registration compliance


Obtaining a CPR is not the end of the regulatory relationship with the FDA. The product and the establishments involved remain subject to applicable regulatory requirements, including those relating to manufacturing, quality control, labeling, distribution, promotion, reporting, renewal, and product changes.


Applicants should also determine whether a proposed change requires a variation, amendment, notification, or new application. The appropriate action will depend on the nature and regulatory significance of the change.




On a final note, because FDA requirements may vary depending on the product, manufacturer, applicant, and intended regulatory pathway, the current FDA requirements should be confirmed before submission.
